Tribunal procedure: amendment of claim by adding new cause of action - Science Warehouse Ltd v Mills [EAT] 09.10.15 (Unreported)

In cases where a claimant sought to amend his claim by adding a new cause of action, he would not have to show that he had undergone the early conciliation procedure in the Employment Tribunals Act 1996 s.18A in respect of that cause of action. The amendment would simply be a matter for the employment tribunal, exercising its case-management powers under the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 Sch.1 para.29 and applying the guidance in the authorities.
