When employment tribunals were determining whether there had been disability discrimination, it was not helpful to draw a distinction between "suspected" and "perceived" disability for the purposes of the Equality Act 2010 s.13. The crucial question was the "reason why" question formulated in Nagarajan v London Regional Transport
