Failure of a Member State to fulfil obligations — Directive 2003/88/EC — Organisation of working time — Organisation of working time of doctors in training. HELD:The Court dismissed the application by the Commission for a declaration that Ireland had failed to fulfil its obligations under Directive 2003/88 arts 3, 5 and 6 by excluding in practice the training hours of non-consultant hospital doctors, as scheduled in the duty roster and falling outside on-call periods, from the concept of "working time" for the purposes of point (1) of art.2 of that directive.
