Whereas the "Maintaining High Professional Standards in the Modern NHS" framework required NHS trust disciplinary panels hearing professional conduct cases to include an independent medically qualified person, the fact that the impugned conduct could be associated with a doctor's work did not necessarily mean that it arose from their exercise of their medical skills so as to relate to their "professional conduct". In a case where the fact that the relevant employee was a doctor was no more than the context in which the allegations arose, there had been no need for the panel to include an independent medically qualified person.
