Reference for a preliminary ruling — Protection of employees in the event of the insolvency of their employer — Directive 2008/94/EC — Article 8 — Supplementary pension schemes — Protection of entitlement to old-age benefits — Scope of application — Offset of a previous pension reduction by the former employer — Minimum level of protection guaranteed — Direct effect against a supplementary occupational pension institution. OPINION that Directive 2008/94 art.8 required an insolvency insurance institution responsible for occupational pensions to take over payments which an employer, now in insolvency, had the obligation to make to a former employee in order to comply with a legal obligation.
