Tribunals' jurisdiction to interpret employment contracts under Part II og ERA 1996 - Agarwal v Cardiff University [CA] 27.09.18 (Unreported)

Fri, 28 Sep 2018

Although employment tribunals lacked jurisdiction to interpret employment contracts in claims under the Employment Rights Act 1996 Pt I, that was not the case in claims under Pt II. Tribunals had jurisdiction to resolve any issue necessary to determine whether a sum claimed under Pt II was properly payable, including issues as to the meaning of the contract.
