CA overturns ruling on sleep-in shifts

Fri, 13 Jul 2018

The Court of Appeal has overturned a decision that carers on sleep-in shifts should earn the minimum wage, ruling that only hours spent awake counted as work. Mencap had challenged an Employment Appeal Tribunal decision in favour of Claire Tomlinson-Blake that she should have been paid the full minimum wage for time spent asleep whilst at the home of the person she cared for.
