Incorporation of documents into junior doctors' employment contracts - Hallett v Derby Hospitals NHS Foundation Trust [QBD] 19.04.18 (Unreported)

The court examined and construed provisions in junior doctors' employment contracts obliging NHS trusts to monitor their working hours and natural breaks. The court considered the extent to which certain documents had been incorporated into the contracts, finding that three Department of Health publications prescribing how trusts should address monitoring were not so incorporated. It also considered how trusts might exercise their discretion to adopt a rational monitoring methodology.
