English High Court declines to grant injunction restraining trade union from calling strike - Thomas Cook Airlines Ltd v British Airline Pilots Association [QBD] 06.09.17 (Unreported)

The court declined to grant an injunction restraining a trade union from calling a strike. The issue was whether the strike ballot indicated the period within which the strike was expected to take place, as required by the Trade Union and Labour Relations (Consolidation) Act 1992 s.229(2D), and it was more likely than not that the court determining that issue would find that it did. If the ballot paper indicated a period within which the industrial action was to take place, it was unlikely that s.229(2D) required any further detail.
