Equal pay and sex discrimination claims based on same breach of employment contract - BMC Software Ltd v Shaikh [EAT] 09.08.17 (Unreported)

The effect of the Equality Act 2010 s.70 was that although a breach of an employment contract equality clause, in the form of a failure to pay a woman the same as a man for like work, was plainly a form of sex discrimination, a complainant could not succeed in both an equal pay claim and a sex discrimination claim under s.39(2)(c) in respect of that breach.
