Divisional Court (DC),The Carltona principle was not excluded in prosecutions against employers under the Trade Union and Labour Relations (Consolidation) Act 1992 s.194 for failing to notify the secretary of state of redundancies. Accordingly, such prosecutions could be instituted by one of the secretary of state's officials.
