EAT ruling on NMW will have serious consequences for social care

An Employment Appeal Tribunal (EAT) ruling that care workers required to sleep in at a user's home are entitled to be paid the national minimum wage (NMW) for all hours, including the hours asleep, will have serious consequences for social care, it is argued. The care worker was employed by Mencap and paid a flat rate of £29.05 for night shift and £6.70 per hour for day work. The EAT found the care worker was entitled to be paid an amount equivalent to the NMW for the whole period she was on shift.
