Whether employer having knowledge of employee's disability - Urso v Department for Work and Pensions [EAT] 25.01.17 (Unreported)

Tue, 21 Feb 2017

When considering whether an employer had knowledge of an employee's disability, the employment tribunal's focus should be on the symptoms and effects of the impairment and not on the condition itself. In addition, there was no good reason to exclude an actual dismissal from harassment under the Equality Act 2010 s.40.
