TUPE - whether transfer had taken place - Alno (UK) Ltd v Turner [EAT] 02.09.16 (Unreported)

The intention of a purported transferor and transferee that a business would transfer under the Transfer of Undertakings (Protection of Employment) Regulations 2006 was not in itself sufficient to justify a decision that a transfer had taken place. Employment judges should apply a multi-factorial approach to the question of whether a transfer had taken place.
