Employment - Election or appointment of employee representatives – Meaningful participation of employees in process in terms of Information and Consultation of Employees Regulations 2004 reg.14(2)(b) – Whether employer complying with legislation. HELD that the Central Arbitration Committee had been entitled to find that an employer had failed to facilitate meaningful participation by its employees where it had invited recognised trade unions to nominate candidates, and had not allowed the wider workforce to make nominations. Employer’s appeal therefore dismissed.
